DEEPFIT may offer promotional, private, or sales-call pricing that differs from the publicly displayed prices. The price agreed at the time of purchase or stated in a written offer will apply to that customer.
DEEPFIT may modify the plans, features, pricing, or availability of its services from time to time. Where a material change affects an existing paid service, DEEPFIT will provide reasonable notice where practicable.
5. MINIMUM MEMBERSHIP COMMITMENT
Standard, Advanced and Pro memberships have a minimum commitment of three (3) months for new members.
Customers may either:
(a) pay the three-month commitment upfront; or
(b) pay monthly through an approved recurring payment method.
If a customer chooses monthly payment, the customer remains responsible for the remaining months of the initial three-month commitment even if the customer decides to stop using the service before the commitment period ends.
After the initial three-month commitment has been completed, the membership will continue on a recurring monthly basis unless cancelled in accordance with these Terms.
6. AUTOMATIC RENEWAL
Standard, Advanced and Pro memberships are recurring subscriptions.
Unless the customer provides cancellation notice before the next scheduled billing date, the membership will automatically renew for the next billing period.
Customers may cancel their recurring membership by contacting DEEPFIT through WhatsApp.
Cancellation of a subscription does not normally result in an immediate termination of access. The customer will generally retain access until the end of the period that has already been paid for.
7. VIP / PREMIUM PROGRAM
The publicly displayed VIP / Premium price is RM1,299 per month.
DEEPFIT may offer selected customers promotional or exclusive pricing, including a two-month VIP package at RM999 per month, for a total of RM1,998.
VIP / Premium packages may be paid:
(a) in full; or
(b) through an approved installment/payment service.
Where an installment arrangement is entered into through a third-party provider, the customer is also bound by that provider's applicable terms.
DEEPFIT does not control the terms, approval, financing arrangements, interest charges, or collection procedures of third-party installment providers.
8. PAYMENTS
Payments may be made through payment methods made available by DEEPFIT, which may include:
• Credit or debit card
• Stripe
• Bank transfer
• Approved installment/payment providers
Customers are responsible for ensuring that their payment information is accurate and that sufficient funds are available for recurring payments.
9. FAILED RECURRING PAYMENTS
For recurring memberships, DEEPFIT may automatically retry failed payments.
DEEPFIT may attempt to process a failed payment once per day.
After three (3) unsuccessful payment attempts, DEEPFIT may suspend the customer's access to the DEEPFIT app and related services until the outstanding payment is resolved.
Any outstanding contractual payment obligations remain payable despite suspension of access.
10. REFUND POLICY
DEEPFIT does not provide refunds simply because a customer:
• changes their mind after purchase;
• stops using the service;
• does not complete the assigned training;
• does not follow the recommended nutrition guidance;
• does not communicate with their coach;
• becomes dissatisfied because they did not use the tools provided; or
• voluntarily abandons the program before completion.
However, DEEPFIT may consider a results-based refund request where a customer has genuinely followed the program but has not achieved the specific measurable goal agreed between DEEPFIT and the customer at the beginning of the program.
Any such refund is subject to the requirements in Section 11.
11. RESULTS-BASED REFUND REVIEW
A customer may request a results-based refund only after completing the applicable program period.
To be considered, the customer must demonstrate all of the following:
(a) Check-in commitment
The customer must complete at least 90% of the required check-ins.
For example, if 20 check-ins were required during the program, the customer must have completed at least 18.
(b) Task commitment
The customer must provide sufficient evidence, including DEEPFIT app records where applicable, demonstrating reasonable commitment to the tasks and recommendations assigned during the program.
(c) Coach cooperation
The customer must have reasonably cooperated with the DEEPFIT coach, including responding to relevant communications, providing requested information, and participating in the agreed coaching process.
(d) Program completion
The customer must complete the applicable program period.
(e) Agreed measurable objective
The refund request must relate to a specific measurable goal agreed between DEEPFIT and the customer at the beginning of the program.
DEEPFIT does not guarantee any specific result, and eligibility for review does not automatically mean that a refund will be granted.
DEEPFIT will review the customer's records, participation, communications, adherence, and other relevant information before determining whether the refund requirements have been satisfied.
12. REFUND AMOUNT
Where DEEPFIT approves a refund under the results-based refund process, the refund will be based on the actual amount received by DEEPFIT for the applicable purchase.
Amounts deducted by payment gateways, payment processors, financing/installment providers, transaction fees, interest, or other third-party payment costs may be deducted from the refund where applicable.
13. CANCELLATION DURING A PROGRAM
If a customer voluntarily cancels or stops participating before completing their committed program period, this will generally be treated as the customer's decision to discontinue the program.
The customer remains responsible for any outstanding payment obligations arising from the applicable minimum commitment or payment agreement.
For recurring subscriptions after the minimum commitment has been completed, cancellation will stop future renewals, subject to the applicable billing cycle.
14. POSTPONEMENT OF START DATE
Changing one's mind after purchase does not create a right to a refund.
However, DEEPFIT may, at its discretion, allow a customer to postpone the commencement of their program to a later date.
Any postponement is subject to DEEPFIT's approval and any conditions communicated to the customer.
15. MEDICAL DISCLAIMER
DEEPFIT provides fitness, nutrition, and lifestyle guidance and does not provide medical advice, diagnosis, or treatment.
You should consult an appropriately qualified healthcare professional before beginning or changing an exercise, nutrition, or lifestyle program if you:
• have a medical condition;
• have an injury;
• are pregnant or recently gave birth;
• take medication;
• have physical limitations;
• have been advised by a healthcare professional to limit physical activity; or
• have any other health concern that may affect your ability to exercise or follow nutritional recommendations.
Customers with existing medical conditions or injuries may use DEEPFIT where appropriate, but they remain responsible for obtaining appropriate professional medical advice and informing DEEPFIT of relevant limitations.
16. NO GUARANTEED RESULTS
DEEPFIT does not guarantee any particular:
• amount of weight loss;
• amount of muscle gain;
• reduction in body fat;
• waist measurement;
• body composition;
• strength improvement;
• athletic performance;
• appearance; or
• other health or fitness outcome.
Individual results depend on many factors, including adherence, training, nutrition, sleep, lifestyle, genetics, health status, and other circumstances outside DEEPFIT's control.
DEEPFIT will make reasonable efforts to provide appropriate guidance and address issues that arise during the coaching process.
17. AI-ASSISTED FEATURES
DEEPFIT may use artificial intelligence and third-party AI technology to provide certain features.
The current AI Food Scanner may analyze photographs of food submitted by customers to provide food-related estimates or guidance.
AI-generated information may occasionally be inaccurate, incomplete, or unsuitable.
AI-assisted features are provided as supportive tools and should not be treated as medical advice or a substitute for professional healthcare, nutrition, or medical assessment.
Customers should not rely solely on AI-generated information when making decisions involving serious health conditions, medication, allergies, pregnancy, or other medical matters.
18. PERSONALIZED PLANS
Some DEEPFIT plans may contain personalized training, nutrition, or lifestyle recommendations.
Personalized recommendations are intended for the individual customer for whom they were prepared.
Customers should not assume that a program prepared for one person is suitable for another person.
If a customer shares or allows another person to use their personalized program, the other person does so at their own risk and DEEPFIT is not responsible for the suitability of the program for that person.
19. ACCOUNT SECURITY AND ACCOUNT SHARING
Each customer account is intended for the individual customer who purchased the service.
Customers must not:
• share their account credentials;
• allow another person to use their account;
• sell or transfer their membership without DEEPFIT's permission; or
• provide unauthorized access to the DEEPFIT app or platform.
Customers are responsible for maintaining the confidentiality of their account credentials.
20. DEEPFIT CONTENT AND INTELLECTUAL PROPERTY

• software;
• graphics;
• branding;
• frameworks;
• systems;
• course materials; and
• other proprietary content

Customers may use DEEPFIT materials for their own personal use during their membership.
Customers must not, without written permission:
• resell DEEPFIT materials;
• reproduce substantial portions of DEEPFIT programs;
• commercially distribute DEEPFIT materials;
• create derivative commercial products;
• scrape or systematically extract content;
• use DEEPFIT materials to operate a competing service; or
• represent DEEPFIT materials as their own.
Customers may share limited information or screenshots for personal or reasonable non-commercial purposes, but any personalized recommendations remain intended for the original customer.
21. CUSTOMER CONTENT
Customers may submit information and materials including:
• progress photographs;
• food photographs;
• exercise videos;
• testimonials;
• reviews;
• feedback; and
• other content.
Customers retain ownership of their own content unless otherwise agreed.
DEEPFIT will not use a customer's identifiable progress photograph, transformation photograph, or exercise video for marketing purposes without obtaining the customer's separate permission.
By voluntarily submitting a testimonial or review, the customer grants DEEPFIT permission to use that testimonial or review for legitimate business and marketing purposes, subject to applicable law.
22. COMMUNICATION AND COACHING
DEEPFIT may communicate with customers through:
• WhatsApp;
• video calls;
• the DEEPFIT app;
• email; or
• other communication channels introduced by DEEPFIT.
DEEPFIT does not guarantee a specific response time from coaches unless expressly stated otherwise for a particular service.
Customers are expected to reasonably cooperate with their coach and respond to communications necessary for the delivery of the service.
If a customer repeatedly fails to communicate or participate, DEEPFIT may reasonably consider the customer to have discontinued participation and may suspend or terminate the service.
23. SUSPENSION OR TERMINATION
DEEPFIT may suspend or terminate a customer's access where reasonably necessary, including where the customer:
• fails to make required payments;
• shares an account;
• misuses DEEPFIT materials;
• engages in abusive, threatening, or harassing behaviour;
• attempts to defraud DEEPFIT;
• unlawfully uses the service;
• materially breaches these Terms; or
• creates a security or operational risk to DEEPFIT or other customers.
Where termination occurs due to the customer's breach, the customer remains responsible for any payment obligations that have already accrued or are otherwise legally enforceable.
24. APP AND SERVICE AVAILABILITY
DEEPFIT will make reasonable efforts to keep its services available.
However, temporary interruption may occur due to:
• maintenance;
• software issues;
• third-party platform failures;
• internet/network problems;
• cybersecurity incidents;
• technical failures;
• updates; or
• circumstances beyond DEEPFIT's reasonable control.
Where a significant service interruption caused by DEEPFIT results in substantial inconvenience to a customer, DEEPFIT may provide an appropriate remedy or compensation depending on the circumstances.
25. CHANGES TO DEEPFIT
DEEPFIT may:
• modify its services;
• introduce new features;
• remove features;
• modify coaching methods;
• change its app;
• change pricing for future purchases;
• discontinue specific services; or
• discontinue DEEPFIT operations.
Where DEEPFIT intends to discontinue a material service, it will provide reasonable prior notice where practicable.
26. NO GUARANTEE OF CONTINUOUS AVAILABILITY
Third-party services used by DEEPFIT may experience outages, errors, or changes beyond DEEPFIT's control.
DEEPFIT does not guarantee that third-party platforms or integrations will always remain available.
27. LIMITATION OF LIABILITY
To the extent permitted by applicable law, DEEPFIT will not be responsible for loss, injury, damage, or expense arising from:
• failure to follow instructions;
• use of a program intended for another person;
• inaccurate information provided by the customer;
• failure to disclose relevant medical information;
• unauthorized use of an account;
• reliance on AI-generated information without appropriate verification;
• third-party platform failures;
• internet or technical failures;
• circumstances outside DEEPFIT's reasonable control; or
• voluntary participation in physical activity despite known limitations or risks.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable Malaysian law.
28. INDEMNITY
To the extent permitted by law, you agree to be responsible for losses, claims, or reasonable expenses arising from your material breach of these Terms, unlawful use of the services, or misuse of DEEPFIT materials.
29. FORCE MAJEURE
DEEPFIT will not be liable for delay or failure to perform its obligations where the delay or failure results from circumstances beyond its reasonable control, including natural disasters, serious technical failures, government action, telecommunications failures, cybersecurity incidents, epidemics, war, civil unrest, or other comparable events.
30. GOVERNING LAW
These Terms are governed by the laws of Malaysia.
Any dispute arising from or relating to these Terms shall be subject to the applicable laws and jurisdiction of Malaysia.
